[Solved] Publishing my daughter's heatbeat

Hi,

Bit of an odd one. I was going to Google this, but wasn't sure exactly what to Google...

Me and a friend are making a video for a piece of music. It's about the journey of the baby in the womb, and we want to put my daughter's heartbeat from when she was in the womb into the music.

I thought it would be a nice touch, not only because it adds to the meaning of the piece, but for my daughter to be able to listen to it when she's older.

I'm basically wondering whether I have free reign, or whether I'd need permission from the mother first? In terms of putting the heartbeat into the public domain, the track will be published on YouTube, Facebook, Vimeo, and hopefully a few cultural websites.

Even if I didn't need to get permission, if my ex was more amicable, I would let her know out of courtesy anyway. Unfortunately, that's not the case. I have no doubts at all that my ex will say no if I have to ask her, just to spite me, and she gets jealous of anything I try to do for my daughter. Ultimately, this piece is for my daughter, and it would be a shame if I have to leave her heartbeat out.

Other options, if they make a difference, include distorting the heartbeat so it's not recognisable, but I'd rather avoid that.

Any advice would be much appreciated.

Quite a strange one, I've had a quick search, but cant find anything to refer to. I cant see it being a problem to be honest, but you could seek some legal advice.

Our website offers free legal advice in the form of a phone call, in partnership with Dialogue First, theres a link in the stickys at the top of the legal eagle section. Youll also find a link to Child Law Advice amongst the stickys too, they may also be able to advise you on the legalities. The CAB mght also be able to help.

Isn't it crazy that you are even having to ask this?

All you are trying to do is something nice and yet bitter exes try to ruin it.

No joy as of yet. I'm thinking because I have pr, it should be fine. Trying to think if there's anyone I can speak to from the music industry who can advise me.
