hi, my wife passed away in april, after i had a non molestation order and child order granted in my favour we had been estranged / separated for 6 months before this, i have now found out that for three years prior she had been claiming child support for our two children without my knowledge and payments were made to her sole account, im a higher tax earner and told her not to claim in 2014. i now have the hmrc chasing me for repayment of the money, her step father is executor of her will and it is in probate, with what happened they are not talking to me or telling me anything about my wifes will. does anyone have any advice please
I would get professional financial advice - I think your issue is beyond the expertise on here as it's pretty specialised.
Your other option is to speak to HMRC directly, to see what solution they are after - they will obviously want their money back, so they may be able to go after the estate first. It depends on the amount involved - it might be cheaper to pay HMRC than to fight any decision.
In my opinion, if you are not a beneficiary of the will, they should look for recompense from her estate, I would direct them to the executor.
I also agree that you should get some legal,advice about it.
