Hi,
When is the latest you can hand in a position statement?
Can the court refuse it if it is too late?
I cannot seem to find clarification.
Thanks
Hand it to the usher and all other parties just before the hearing.
Thank you
As above unless you have been directed to provide one by a certain date (which sometimes happens)
Thanks Yoda, sorry i missed your response.
The only thing i could find possibly related to this, is that the court order says all PD documents must be filed before 11am on the day before trial-does this include my position statement?
What sort of hearing is it and how long is it listed for? Have you been directed to provide evidence or a statement? A short position statement can be handed in on the day but it does depend if there's anything in the order that says otherwise.
Hi Yoda,
It is a NMO hearing scheduled for one day.
I have already provided evidence over a couple of months ago.
The only note in order that i could find possibly related to this, is that the court order says all PD documents must be filed before 11am on the day before trial-does this include my position statement. There is no mention of position statement.
I was going to ask for interim contact in position statement,as cafcass suggest Friday to Monday every other week. I have not had any contact for 6 months despite no NMO judgment as yet. I am very confident NMO will be found false. I have alot of independent evidence from statutory services.
Mojo has suggested I complete c200 form as the judge may ask for this for interim contact procedure. My next hearing is a directions one on 19.12.18 and I did not want to wait until then to ask for contact. However, maybe this request cannot be heard at NMO hearing? Ex has suggested contact but only in a without prejudice letter that I may not be able to show the court.
Thank you
