Would anyone who has had to write a position statement please have a read of the below, offer me any advice, any pointers. I've taken out all names, locations.
This is my 1st draft, Am I on the right lines?
1. I have made this application to the Court so that I can have an order permitting me to
see my daughter xxxxx on a regular basis. The current situation was 9am to 4pm every Saturday. This has been cancelled by the respondent xxxxx, leaving me with no access at all since the issue of the court papers. Having watched xxxxx deny access and ignore attempts to contact her to restore access with a previous partner and his parents, I fear without an order in place this will happen to xxxxx.
2. The parties separated in February 2015 and arrangements for contact have been dictated by xxxxx. We had attended several mediation sessions getting access to 9am to 4pm every Saturday. The talks stalled there, which resulted in us being told to get legal advice. Mediation broke down completely when xxxxx refused to continue mediation to discuss the legal advice I was offered.
3. To date, xxxxx has not allowed xxxxx to stay overnight at my house, or for me to take xxxxx to see her family who live in xxxxxx, even though this was a planned event before our separation.
4. I would like the Court to make an order in the following terms:
Alternate weekends, contact from Friday 6pm until Sunday 5pm
Every Saturday day on the opposing weekends, or some practical amount of time in between weekends
Two weeks holiday in the summer
One week at Christmas
One week at Easter
Alternate or share Birthday, Christmas, Easter etc.
5. I believe that the terms I am requesting will be beneficial to xxxxx, will offer xxxxx both parents in her life and the ability to visit and grow up with her Cousins, Uncles, Aunties and Nan. It would also aid in the continued building of the relationship between xxxxx and I. The whole focus of my intentions is to offer xxxxx the most stable, balanced and enjoyable life possible.

Perhaps you could start with a brief background....when you met, moved in together, birth of child and break up. What age your child is and how close you are.That there was a child from a previous relationship that is estranged from their paternal family.

I would say we separated rather than the parties, just a small thing and where you have written us I would write I.

A couple of sentences about how much your child would benefit from having full involvement with her wider family and how having a full weekend would allow her to have quality time with you and allow for activities that you could both enjoy together.

Every Saturday day on the opposing weekends, or some practical amount of time in between weekends
Two weeks holiday in the summer

Alternate or share Birthday, Christmas, Easter etc.perhaps you could request that as contact was regular up until xxxx received the court papers, that the court consider making an interim order to allow contact to resume. That stopping contact so suddenly will have been distressing for your child and is not in her best interests.
5. I believe that the terms I am requesting will be beneficial to xxxxx, will offer xxxxx both parents in her life and the ability to visit and grow up with her Cousins, Uncles, Aunties and Nan. It would also aid in the continued building of the relationship between xxxxx and I. The whole focus of my intentions is to offer xxxxx the most stable, balanced and enjoyable life possible.
This a good and concise position statement, you stick to what is important without resorting to negative comments about the mother.
