JM v CZ [2014] EWHC 1125 (Fam)
Judgment on costs arising out of proceedings under Part IV of the Family Law Act 1996. Mostyn J also gives consideration to section 45(3) of the Family Law Act 1996 and the general principles that should apply on an ex parte application.
Hi NorthernGuy, saw this earlier and thought it might be of use to you 🙂

Thanks for that, it does make depressing reading though how our Court system doesn't recognise this, how Cafcass don't understand it and just generally it is swept under the carpet.
Something has got to change at some point, no all non resident parents can be nasty enough to their kids for them to turn around and say they don't want to see them again.
It does, doesn't it? It might be a useful document to use if you're going back to court though? I'm assuming you would be allowed to use research documents to prove a point?
Did you try to get hold of Karen Woodall at all?
Sending best wishes 🙂
Not sure what I can use of that, apart from to tell Cafcass and the Court that they should get up to speed with this sort of issue.
I did, they suggested writing a position statement...... which then didn't get read. Oh well....
