Hello!
I'm looking for a little be of advice / guidance in relation to my paternity leave. Hopefully any of recent parents here may have experienced this and will be able to help.
My partner is due to have our baby by c-section on the 14th of December . I would be looking to take 2 weeks paternity starting on the 14th. My main concern is regarding the two public bank holidays (December 26th and 27th), will my paternity leave disregard the two bank holidays? Resulting in me losing my bank holidays, or will I be able to take the bank holidays at a later date within this holiday year?
I am currently entitled to 30 days holiday a year (28 as statutory and 2 extra days for the length of time I have been with the company).
Below is a few relevant snippets from my contract:
You are entitled to 28 days per annum (based on working 5 days a week), which is inclusive of the recognised Public Holidays. You may occasionally be required to work on a Public Holiday, you may be entitled to the day off in lieu.
Holiday entitlement increases by 2 days each holiday year, after each complete holiday year in employment, up to a maximum of 38 days per annum.
You are required to take at least one week's holiday during the schools' summer break and 3 days to cover the working days between Christmas and New Year.
Any links to any relevant government websites would be most helpful. Thank you
hi, and welcome.
Looking at your contract, the bank holidays are part of your holiday entitlement, not as extra (mine is 20 days plus statutory bank holidays).
The holiday entitlement is 5.6 weeks:

This basically says you are legally entitled to 28 days holiday, so any paternity entitlement must be on top of this. I'm not sure about your 2 extra days, but since they are contractual, I cannot see that they can take this away. I'll see if I can find any more.

Hi actd!
Thanks for this! I've yet to talk about it with my employer, I just thought it would be good to get some knowledge within me. It sounds like I may be able to say I am contractually allowed 30 days holidays exc. paternity leave.
Hi,
Yep, that's how it looks to me - with any luck, your employer will agree.
