Hi all,

New to this forum so here's a quick intro before my question.............

I've been separated from my ex (wasn't married) for about 4.5 years now and have a residence order for our 2 children (8 & 6 years old).

My ex has recently met, got pregnant & will be marrying this month a chap from Nigeria, she has told our children that she will take them to Nigeria to meet his family (she hasn't been yet either).

I have our childrens passports so is there any way she can apply for new 1's? Can I stop this if she does?

I know that as we both have parental responsibility, she has to get my consent before taking them out of the country & as I have residence I don't need her consent, but am worried she might try without my consent.

Thanks in advance

Matt 🙂

Hi Matt,

You are only allowed one passport and I think she would need your signature to apply for a new one if for instance she tried to say that theirs had been lost. It would be simple enough to call the passport office and get some clarification.

If you are really worried you could apply for a Prohibited Steps Order through the courts.

I think as you have the passports and a Residence Order you are in a fairly secure position but I understand your concerns.

If I recall correctly, you can write to the passport office stating that she cannot apply for a passport for your children (eg, claiming it's lost - especially if she signed the forms for the original application) - send them a copy of the residence order. I think you might have to write to them every year to keep the notice in force. Certainly worth ringing them to check.
