Hi ,
Anyone got any experiences with CAFCASS recommending partners can’t come into contact with child?
Background - Enforcement hearing last week . Ex claims my child is being emotionally harmed by my partner . He has been very upset for contact but I do not believe this has anything to do with my partner . Ex had a witness statement off childcare provider and text messages that supported her allegations ( me admitting that my son is upset I’m my care but not suggesting this is to do with my partner ) Apparently my son is saying it is her he’s “ hates “ and that she smacks him and he doesn’t want to see her .
Court Ruled interim order and sec 7. The interim order is for me to have contact but I can not take my son into contact with my partner .
Anyone got any ideas what the sec 7 will recommend? Will my partner be able to see my son or is the ‘ evidence ‘ my ex has enough to convince cafcass ? I strongly dispute what my ex is saying but I’m aware that the evidence she has does not portray in a good light .
Next hearing isn’t until November now
Thanks guys
hi,
can you please explain why there was an enforcement hearing?
as far as S7 report, it could be anything. i am assuming they will investigate emotional abuse of child. they will interview your partner for S7 report, and he will have to answer to allegations, as well as what kind of contact he wants with child.
I applied for enforcement due to ex stopping contact with my son . She has given the reason as safeguarding concerns and is saying my son is emotionally harmed by my partner .
The section 7 has been ordered to cover the following ;
-how much contact I should have with my son
- whether that contact should include my partner
Obviously my partner will disagree with the allegations and so will I . My ex has the childminder statement and text message evidence though so I was wondering how cafcass actually determine who should be allowed contact with my son ? How do the actually investigate these kind of allegations? It’s different to drug /alcohol etc as those can be proven with tests whereas I’m assuming it’s harder to prove ?
Thank you
hi,
how old is the child?
during my s7 report process, my 5 year old child was spoken to by cafcass. to find out if she is happy with me, happy to go to my house etc. they also made her do drawings to find out if she is happy or not. if the child has been brainwashed/emotionally abused by anyone, cafcass should be smart enough to spot this.
He’s 5 .
What will happen if my son says he doesn’t like my partner ? What drawings do they get them to do ? The childminder statement says that they are concerned with how my son is treated when in my care and that he has said he hates my girlfriend and that “ she should die “ the text messages are from me to my ex saying he’s unsettled and upset at my house and could she collect him . I admit he has been upset etc but I don’t believe it’s abything to do with me or my girlfriend.
hi,
mine did drawings of a house, asked to draw family members. daughter was asked who is most important. she chose one of my sisters little kids lol. dont worry. as the child is saying weird stuff like "she should die", that will stand out like a sore thumb and cafcass are not going to like that one bit.
Hi , Thanks for replying
What do you mean that cafcass “won’t like that one bit “ ? As in it looks bad for me ?
I bought the “she should die “ comment up in court and the cafcass officer said that although he agreed with me that my child didn’t have the maturity . Children do express who they do and do not like in strong ways at that age and that he had “ serious safeguarding concerns “
