Ive now had 4 cases, and been at court over 10 times now as a litignat in person.
And have what should be a final hearing on Monday.
However yet again the mothers solicitors have not sent me copies of their Preliminary documents, they are deliberately doing this to make life difficult.
I even wrote to the judge after getting the last court order asking for them to have to send me them several days before, needless to say he didnt.
As i have not seen their position due to not receiving them shall i ask for the hearing to be adjourned to a future date?
Are you waiting on a statement? A bundle?
As far as asking for an adjournment, it depends how badly you want to get the case concluded... are the documents you’re waiting for necessary to progress the case, or can you manage with approaching her solicitor at court, before the hearing and asking for the paperwork then?
I understand it’s frustrating, but is it worth delaying your case for?
Ive had the bundle it is the preliminary documents stating the mothers position in relation to the CAFCASS addendum and also a social services report.
SO turning up on the day then working out what to do from there puts me at a huge disadvantage when they have my preliminary documents plus an expensive legal team.
THis case has gone on for 3 years now another couple of months wont hurt.
Were the CAFCASS and Social Services reports favourable to you? If so, I’d go with that momentum and focus on/argue your own case, rather than base it on hers.
However, you’re best placed to know what’s best.

CAFCASS have recommended mother is served with a 91 14 bar, they quite clearly see whats going on.
In that case, going for an adjournment might be playing into her hands.
