Hi,

I was just wondering if anyone has been in the same situation.
Due in court in the coming week for the first directions hearing and the respondent has not filed her C7 to the court to show that she has received the application.
She is trying to dodge the calls from Cafcass also.
Any advice on what should happen next? I am an LIP and feel this is just something to try and put me on the back foot before we start.

Thanks in advance.

The only thing you can do is attend court and see if she attends. If she doesn't there is likely to be an adjournment.
Did the court serve the papers on her?

Give the court help desk a call and see what they advise. Unfortunately courts all have their own way of doing things, which makes it difficult to predict how they will deal with it.

What if I can prove via a text message that she does know all about it?

You should screenshot them, print them off and take them to court with you.

At the first hearing cafcass will also be there the court may adjourn or go ahead without the other party however if the other party doesnt play ball with cafcass or the court it is a long drawn out process they may issue an interim child arrangements order and depending on the situation order further reports from cafcass pending the final hearing. If a final order is not complied with or the other party still dodging the court system then u have to pay another fee and fill in an enforcement application and go through first hearing again

In my case my ex has not played ball at all with the court the 5th hearing is coming up and still no end in sight
