when i spoke to cafcass they said that at fhdra, the court will want to know results of my contested non molestation hearing
so does that mean they will adjourn until after my non mole trial?
cheers guys and girls
Not necessarily. Cafcass always go on the side of caution, but depending on the circumstances, the judge might be willing to move things forward. Cafcass can recommend, but ultimately the decision lays with the court.
Sometimes it's helpful to ask for the non-mol and children's proceedings to be listed together. If nothing is going to happen at the FHDRA, perhaps you can ask for this so as not to waste time and have the same judge hear both issues.
i didnt realise i could ask for that yoda as the non molestation and fhdra are in different courts? or would that make no difference?
It depends how far in to both sets of proceedings you are, but it is common for proceedings to be combined. Obviously if your non-mol has a final hearing before the childrens matter, then there would be no need, but if not, you could ask at the next hearing - whichever is first.
thanks yoda, my fhdra is 16th october and then i have a pre trial on 3rd november and trial on 2oth november for non mol
still havnt received ex partners statement she was ordered to produce 14 days before fhdra...have wrote to court and asked her statement be disregarded π
