[Solved] No C7?

Hi All looking for some advice

My ex is applying for a child arrangements order for my kids to live with them. She says in her C100 that I am agreeing to this (which I don't), she also saying that I don't want contact with them. which I do.

It is a long story but to cut it short she has been denying me contact since July. Ex wants to take the kids on holiday but won't give me details of where and when she just expects me to agree. she has now applied for a child arrangements order to say that the kids live with her.

I have received her C100 from her solicitor but there is no C7 included is this because she believes it is by consent or is it just her solicitor trying it on?

Cheers in advance

Hi,

I take it your children live with your ex for the time being??

What she says in her c100 form sounds like its [censored] for tat, court will know that . If the accusations are more serious then it would be a different story but if its little things like saying you dont want to see them then its your word against hers, just sweet talk CAFCASS.

If you have PR then she does need to let you know where they are going and when she is taking them but things like this are tricky, if you took her to court over such a thing is it worth the hassle?? Let her have her glory, let her take them on holiday and let the dog have its day, thats my best advice. I think its a power thing, both parents want to feel in control but sometimes you got to let it happen and think about the future instead of getting angry about the now.

I am not sure about the passport thing im afraid.

Paul

Thanks for the response

It is not just the holiday. my ex does not pass on school reports / school events. she withdraw our boy from the 11+ without talking to me. and choose his secondary school.

I am really just asking if I need to fill out a C7 in response to her C100 application as one was not included in the application from her solicitor

Hi,

I have always been the one to file the C100 forms, im sure ive done C7 forms also, but by the looks of it if you want your case to progress as smooth as possible then comply with all relevant forms.

Again, as for getting information about your child like events and schooling, you do have a right to know all these things 100% but you need to breach her and take her back to court, is it really worth the hassle and it could upset the things and jeopardise the what you already have in place. I know its hard but it is what it is, the whole system is flawed. I have had decent results every time i have gone to court but the mother does not always follow them and its such a long laborious process to get it looked at. At the end of the day its up to you what you want to do, i whipped the mother back to court as much as i could but trust me, it does not work. The mothers are far more powerful than any judge in the land, i promise you.

The C7 form is an acknowledgement of service, her solicitor should have provided you with one when you were served the paperwork. You can give them a call and request that they send you one out, or contact the court and explain you haven't received one.
