The child won't know it's his first birthday and won't remember.

At the earliest children know it's their birthday on a particular date when they are about 3 but most only learn when they are 5 due to going to school.

So celebrate his birthday on the nearest date you have him and don't create battles you don't need.

hi. yes it doesnt sound like much. the baby is now 9 months old. the way things were sorted out in court, was so that when i drop my other 2 kids back to their mum on sunday, i see the baby then. also if the baby gets hungry, then i am in trouble lol. so better i stay close by. the plan is for baby to spend time at my house when she's a year old. so not long to go. and looking for more time with baby as she gets older.

Thanks everyone,

When I say they i mean the mother and my ex. I accept i need to be patient with having my son up to scotland and overnight even though it sucks..

I am worrying about his 1st birthday, in November. If me and the ex dont like being around each other i dunno what approach to take or what to expect but what would you suggest? Im really worried my ex gets selfish and I cant see him at all on the day, i couldnt handle that.

With regard to court i am trying to get it in motion now, can anyone give answers to the following;

How to I arrange it, how do I apply?
When I do apply should I have a lawyer organised already? If so should i have went through everything with them before making the application?
Are there any options for people who dont have 1000s to spare when it comes to a lawyer?

Thanks so much to all

hi wyatt,

to get court ball rolling, first you will have to try mediation. plenty of mediators out there, that do video calls etc. before this speak to your ex and try make arrangements to see baby, even if 1 hour a week or if she will let you see baby on birthday. if she doesnt agree to anything, then arrange to speak to mediator.

if mediator feels like mediation is not getting anywhere, they will sign you off to make a court application:

C100 - child arrangement order. to save money, print off paper form, and take it to a local PSU office. they will sit with you and fill in form, free of charge -

https://www.thepsu.org

c100 form: https://www.gov.uk/government/publications/form-c100-application-under-the-children-act-1989-for-a-child-arrangements-prohibited-steps-specific-issue-section-8-order-or-to-vary-or-discharge

court application costs £215

i spent few thousand on barrister. there are other dads on here that have done it alone. they can better advise.
