Hello Can someone give me some advice please... I have an on going issue and before i take this further i would just like to know where i stand with my rights " if i am the Father " I was named as the Farther on the birth certificate and i was not present as i weren't told i was a dad .. Does the Farther of the named child have to be their or give his consent if not proved by a court of Law that "HE" is the farther of the named Child ?

Thanks

James

I believe you would have to prove that the child is not yours via a dna test and then a court will order your name is removed.

Hi there

As far as I'm aware you would have to be present at the registry office for your name to be included on the birth certificate. If you have been told that you were put on it in your absence I suggest you ask to see proof!

If you have doubts that you are the father, for instance if you are contacted by the maintenance service to pay child support, you must tell them immediately that you are disputing parentage and require a DNA test. You will have to start paying the amount they say whilst the test is done and you may have to pay for the DNA test, but if it turns out you are not the father they should reimburse you.

A mother can open a claim for maintenance even if the named father isn't actually on the birth certificate.

If it isn't a matter of maintenance, but you have doubts you are the father, you can apply to the court for a declaration of parentage and the court would most likely order a DNA test to determine this.

If you are named on the birth certificate you can apply for a copy yourself
