[Solved] Name on birth certificate

Hi I'm not a dad I'm a Nannie.
My son is on the birth certificate as a witness not as father, he has joint parental custody and the child lives with him,, for 7 years,how can I get his name on birth certificate without mothers consent. It would mean the world to him. Thank you

Hi there

I didn’t think a birth certificate was witnessed, except by the Registrar. I’ve had a quick check and can’t find clarification of that.

If your son has joint parental custody and that has been ordered by the court, it’s likely he would have been granted Parental Responsibility, if that the case he can apply to have his name added using this form

If the parental custody was a private arrangement between the parents, and the mother won’t agree to his name being added by making a Parental Responsibility Agreeement, he would need to apply to the family court
For Parental Responsibility.

If he was to do this I would also recommend he applied for a Child Arrangements Order to state that the child lives with him and a Prohibited Steps Order to prevent her removal from his care.

However, if the child lives with him, without knowing the full circumstances of that, sometimes it’s better to leave it alone.
