My Wife Took My Son To A Different State and Want to Stay Permanently

We are married for 2 years and have a 7 months old. We had a physical altercation where I assaulted her, partly due to frustrations at wife constantly speaking to me disrespectfully. I put with it the entire marriage and finally lost control recently. We never got physical. This never happened before.

I was arrested and release to find my house empty. A lot of events have taking place since. I have since filed a petition for custody/visitation and called to be summoned on Jan 6. In the meantime, I'm going to get myself together to present a compelling case that I can raise my child. My wife is flip-flopping on divorce, and frankly so am I. The judge did tell me she will rule that the child does not leave the state when he comes back.

Can anyone offer insights on what will happen on Jan 6?

Also I was okay with her leaving, just not permanently with my child. I offered to leave for however long she needed. She declined. 

Again, what I did was wrong and I accept what has happened.

First question - you mention state, does this mean you are not in the UK?  We are UK based and may not be familiar with law in other countries.  Second point is that you have already had a hearing.  Is that for child contact?  Are you likely to be charged with assault?  That could affect the outcome.
