Nobody can predict what an individual court would decide. Financial matters are complex and every case is pretty unique. You will both have to provide the court with full disclosure and then they will look at both your financial circumstances and housing needs before reaching a decision.
It's not going to be a quick process, but in light of no mediation, lawyers and court are your only options.
