Hi, I would really appreciate any help I could get on this matter.
I have my kids on a regular basis on set days but often have them extra at their mums request. When I went to pick them up on Wednesday she asked me inside and told me she was moving out of the area. I asked the reason and she said SHE needs a fresh start with her new boyfriend, my boys are 5 and 6 but she also has 2 other children aged about 13 and 15. All children are settled in really good schools that have really good ofsted reports. I have spoke to the head teacher at my kids school and she also thinks it is a terrible idea for them to move with her. Ive also spoken briefly with a solicitor who didn't give me much information other than it will cost between 3 and 5 thousand pounds to see a case through the courts. I'm not in a great financial situation and would have to beg, borrow and steal to get that kind of money. If I did go through with a solicitor do I have a good chance to stop the move? I greatly appreciate any input. Thanks
Hi there
There is no reason why you can't represent yourself. When is her move? If it is imminent then you can apply to the court for an urgent Prohibited Steps Order. This will cost £215 as a one off charge. The fact is if you take on a solicitor you could be looking at a lot more than the amount quoted, unless you can get a fixed fee agreement.
If you apply to court then at least you can get a temporary hold put on the move until the court can look at it in more depth. If you have lots of evidence that the move would be detrimental to the children then you may be in with a chance, especially if she hasn't been in the relationship long and she will have no support network where she is going.
If you don't feel that you want to go to court and she isn't intending on moving for a couple of months or so you might like to consider Mediation to try and resolve this. Here's a link to the mediation service

Good luck.
