Hi Guys
Any help would be greatly appreciated...My ex is taking me to court shortly under schedule 1 and under Tolata.......
We were not married and our house is joint names.... she is trying to claim all of the house .....we have a 85/15 share ..... her share being the largest.
she is claiming that I should have no right to my share in the property..
I just wondered if anyone else had been through anything similar and what I can expect in court....?
Thanks
I think you need to speak to a lawyer dealing in property - the citizens advice bureau may be a good place to start.
How does she have an 85% share - was that done as a tenancy in common?
Are there any children involved?
Im a joint owner but not other agreements and my ex is only entitled to 50% of the equity although she is asking for more.
If there is any agreement such as tenancy in common then she should surely only get what was agreed.
You cannot, in my opinion, be made homeless, although she may get away with this.
Agreed you need legal advice.
Regards,
Dave
