hi all,
i have been with my girlfriend for 6 years and have 2 kids,
last week she went on holiday and when she came back she said she no longer loved me, and has moved to her parents house about half a mile away and im still at the family home with the kids.
she was reluctant to go at first but i said its mine and the kids home and they should remain in there home.
she is able to see them as much as she wants and i have been perfectly amicable about it,
all i want is something formal to say that the boys are living with me so she doesnt just take them one day! what should my next steps be?

I think you are right to get something in writing that is legally binding. She could just take them and there wouldn't be much you could do about it.

The first step would be to apply for residence order. You can do this as an emergency and you would be in court within a day or so. You can do this with or without a solicitor. Legal Aid has been stopped for Family Law cases so if you went to a solicitor you would have to pay, and it's not cheap. The alternative is to self represent, this is doable and there are many here that have taken this route.

If you take a look at the top of the Legal Eagle section you will find a couple of stickys about representing yourself in court and another about the C100 form, this is the form you will need to apply for residency.there is a charge to submit the form of £200 but if you are on benefits or a low income you can apply for an exemption and this is done with form EX160a.

My advice is to act sooner rather than later.
