[Solved] minute of agreement Scotland

Hi, just looking for some advice.

My ex and I are currently separating and she has had a minute of agreement drawn up.

The only issue i have with the agreement is the wording around the child maintenance element of it, which it states i will pay £x amount per month to be review and increased annually in line with any increase in my wages.

my worry is, if I'm made redundant or take a job on lower wages i will be stuck paying £x amount per month even though it may not be possible to do so.

I've suggested we have a voluntary agreement through the cms but she is determined to have it written into the minute of agreement.

Is there a way to word it within the minute of agreement that would allow for changes in circumstances/employment that would allow the figure of child maintenance to reviewed?

I'm not sure how Scottish Law works to be honest.

Is the amount you are agreeing above the CMS liability?

Yes, the payment is more than the cms calculation.

I don't have an issue with the amount currently, my only worry is if my circumstances change I may be unable to pay.

I think it's something you need to address now rather than later

You could try contacting Families Need Fathers Scotland for help or someone with more knowledge than me on these issues in Scotland will be along,
