Morning. I need to file a c100 as current child arrangements order completely obsolete and everything’s changed , ex won’t agree in writing and won’t agree additional contact so I need to take it back to court . Last year she accused me of threatening her , no evidence and I accepted an undertaking on a no admission basis . When I fill in the c100 there is a box I can tick ‘
- Evidence of an undertaking given (in England and Wales under Section 46 or 63E of the Family Law Act 1996) where an equivalent cross-undertaking was not given.
but problem is that is comes under the heading ‘when there has been evidence of domestic violence ‘ which I don’t feel comfortable with as there was none .
can anyone advise what I should do ?

When was your last court hearing for child arrangements?
If there is a non molestation order in place, then it means you can skip mediation, and go ahead and apply with C100. Are you filling the form online? Much better than paper version. Feel free to message me for advice.
