If you think she will do a u turn on anything agreed in mediation and you manage to anything agreed in the first joint session; it might be an idea not to have the second session for a month or so and give it time to see if it will work. Saves you throwing a lot of money at mediation.

If it becomes apparent during your first joint session that you can't agree, I wouldn't waste time and money repeating the experience, just get the mediator to sign off on the C100.

I sit with Slim on the mediation fence. A lot of them are useless and will drag it on for the sake of it, same as a lot of solicitors. Mediation only works if you're both prepared to compromise a lot and even then it's not legally binding.

A consent order is possible if you can agree although many courts would make a 'no order' if you're both appearing to be amicable and in agreement and would waste your court fee.

So I have my MIAM on Monday, just wondering what advise you woukd give. How I should present myself, and layout my plan. I'm going to print off a parenting plan and send one to my ex to fill out as well. What else can I do to get the most out of the MIAM

What's the position, on arranging days and letting the other person know? Since I mentioned mediation I am sat here waiting to hear if I am having my daughter today or tomorrow. How long can I leave it today before saying it's unfair and unreasonable and to short notice? It's not that I wouldn't go and see my child at the drop of hat because I woukd but surely I need to document that this isn't the way things should be?

The mediator should try and guide you both, when you're preparing the first draft of your plan be aware that you need to be flexible and prepared to compromise. Of course she may not be happy to use the plan if she is intent on maintaining control.

From experience so far she will be more than happy to agree to things but actually doing them is a different matter. All the excuses come out and phone batteries die just at he right moments etc.. I'll see how it goes, I'm not writing it off just yet but I'm not holding my breath.
