[Solved] mediation and the next steps?

hi all

I am new to the site so please redirect if needed.

I am looking for some advice on mediation and the next steps if this doesn't work, I have attended mediation with my ex-partner around 18-24 months ago and all has been relatively fine since then. my issue now is she is reducing my contact with my daughter, that we had agreed to in mediation, to every 2 weeks when it had been every week.

her reasons I believe to be unjust, and now I am finding out that my daughter is staying at other relatives houses on the days which were my agreed nights.

so my question is will I have to attend mediation again or can I take the next steps to get arranged and set visit days and times.

As far as I am aware the time allowed after mediation to go straight to court is 18 months (it may be 24 months though), the best thing to do would be to call your local family court and ask them for advice on whether you would need to firstly re try mediation to resolve things before applying, they are usually quite helpful when you call.

From the sounds of things if your daughter is spending the time she used to spend with you at other relatives houses then you have a strong case to get that time back, especially as it had been in place for so long.

My letter from mediation after it failed said it only lasted for four months. You could call a mediation centre and ask them.

I have tried to take it to court but I'm constantly told I have to go back and try mediation again this is been over a four year period and been to mediation three times each time an agreement has been made but each time she breaks it and changed it and she is cutting me out of my daughters life my daughter is now 14 and when asked again about going to court people are telling me is too late at 14 basically I've got no hope

At 14 her wishes will carry a lot of weight, but strictly speaking you can ask the court for an order up until she reaches the age of 16.
