just a quick question

*I wanted to make an application to court to vary an existing order due to current terms expiring soon and new terms due to kick in are not suitable for me as they clash with my shifts. and i wanted to get school holiday contact added in due to ex not allowing any at all by mutual consultation.

*anyway i wrote to ex with a proposal, she didnt reply and verybally refused to compromise , I was sent a text reply saying im happy with court order knowing full well its not right for me. (shes just showing shes not in breach of anything)

* So i applied to MIAM, attended my miam, explained situation, and the mediator seemed to agree there would be little chance of resolving it and would be going in circles as she doesnt want to co-operate.

* I paid for my MIAM, £96. and they wrote to her/called her re booking an MIAM but she fobbed them off with excuses hoping the problem would go away and il back down and stick with what i got

* the Mediator signed my form to show i had attempted mediation and i applied to court
court hearing for directions hearing and FDRA came through as i requested urgent hearing due to date/time restraints involved

* Now Mediation people rang me stating she has sent in paperwork to prove she is eligible for LA. its just a stall tactic to show she will co-operate, but i know full well she wont attend or wont agree to anything at mediation anyway so utter waste my time. so just going in circles and anything agreed at mediation she wont stick to because her legal adviser is her sister lol

ive already took unpaid time of work to get to this stage, paid for mediation and court admin fee

can the court order to go step back to mediation or will it progress forward now to submit position statements/as to what issues are so the matter can be dealt with at court.?

Hi There,
.
You would like to think that the judge would see that she is time waisting by now looking like she will attend mediation, I think I would continue to court as you have the form signed and see what the judge says, he may refer you back to mediation, but hopefully he will see what she is doing and just allow the court process to continue.
