Evening all.....
Had a directions hearing today where my ex solicitor informed that they have applied for legal aid based on the fact that she made an allegation of DV a few months prior to leaving the family home.
It seems she spoke to a social worker and alleged physical and mental abuse which was not reported to the police however it seems that there was a multidisciplinary hearing (macro?).
It surprises me as there was no abuse from me and she admits to slapping me in her court statement whilst I was driving but denied any abuse against me in the S7 report.
My question is;
What is the criteria for her to get legal aid as it seems if there has been a multidisciplinary hearing by social services then she may get it?
There was no abuse and the police have never been called, there is approx 60K equity in the house so I think in essence she has 30K assets.
When I run it through the legal aid calculator it seems she is not entitled.
I ask as she has made allegations of drug abuse and I agreed to be tested and seems to be trying to string things out and be more difficult.
I wont go into the detail but she also tried to decrease my contact and asked that she can call our children when they are with me and the judge disallowed theyre requests.
Any thoughts on her legal aid request?
Regards,
Dave
