I got divorced 4 years ago and my ex claimed DV,had no evidence etc and got legal aid.She was told what to say by her solicitor to qualify for it.I am in position were I think she might take me back to court in regards to child access,would she qualify for Legal Aid under the first claim of DV ?
Am I right if this is not the case she would not qualify for Legal Aid for taking me back to court in regards to child access ?

I think they've increased the time limit for applying historic DV to legal aid, from 2yrs to 5yrs, however I would certainly check this.

However they have tightened up, so she would require some proof of DV... but I wouldn't like to state categorically that she wouldn't get it by using the fact that she was awarded it before.

I have found some further info online and there is no time limit on how long after she can claim,however proof of DV is required in a list of stated formats,such as police report etc.
If someone is claming Legal Aid by not being honest,can you challenge or report it ?

Yes I remember now... it was 2yrs, then it was 5yrs, and in Feb 18 they changed it to no limit.

You could try contacting the legal aid agency, to discuss your concerns. Here's a link, if you suspect that a party to proceeding has lied in court, or is receiving legal aid falsely.
