Okay guys, I have a bit of a complicated situation here that I am hoping someone can help me out with...
My ex girlfriend (not married and no kids) had me served with a non-molestation order back in January even though I never actually done anything and I can swear down on this; she just wanted me out for whatever reason but it was a bit of a weird order as I was actually allowed to stay in our home but wasn't allowed in the bedroom with her :\ ... anyway, about 3 weeks later she decided that she clearly wasn't happy with this order and made a ludicrous claim to the police that I assaulted her (which I can swear down on that I never did) and she gave herself an injury to make it believable and I ended up getting arrested, charged and I'm in court in the next 2 weeks over it.
This claim was about 5-6 weeks ago and I have been homeless, living in hotels, AirBnb apartments etc. which as you can imagine has costed me an absolute fortune. In fact, I have spent most of what I have now over it all. What I'd like to know is seen as we are on a joint tenancy and we've lived there for 10 years together, will she be able to remove me from the tenancy without my permission? She has also started selling off my stuff and my PETS without my permission which I am really hurt by as I'll never get to say goodbye to these pets of mine when I had them for years... Is this even allowed? Surely it's theft??
Anyway, I have had it up to here with it all now and I can't remain homeless like this for much longer so if possible I want to be getting back to my home and telling her to do one if she isn't happy after everything that she has done. Would this be possible with it being a joint tenancy? I'm under the impression here that it's equal rights.
Also, if in court she tries to get me to sign papers to pass the tenancy over, do I have the right to refuse? I've literally been kicked when I'm down and I feel like enough is enough. I've came out of this depressed, struggling and just all round unhappy... Why should I be made to be this way when half of the home is mine? What are my rights in this?

A bit of a complicated situation is a bit of an understatement... with the criminal assault charge looming, you’re in a pretty precarious position.
Basically, it’s your word against hers, but if she has a visible injury, it’s going to be difficult to prove that it was self inflicted, especially as she already had a NMO against you. My advice is don’t go anywhere near the property, she can just as easily make further allegations.
I would contact the council, I think they can remove someone from a tenancy agreement, but I would certainly get some more information about your position regarding this. You could give Shelter a call, I’m pretty sure they will be able to advise you.
As for selling your property, I would say that is theft, but I would speak to the police about this... can you prove the pets belong to you alone?
I’m sorry I haven’t been able to tell you what you want to hear, tread really carefully, she sounds like a dangerous ex.
