Hi,
I need some advise on what to do...
I have a financial court order that states my Ex must sell the FMH forthwith.
She put it on the market and recently accepted an offer, but the estate agents have been chasing her for details of the solicitor she plans to use, but she has not provided the information after 5 weeks. I suspect she doesn't want to sell the house and I will need to go back to court to effectively get the judge to force the sale through, but I don't know what the next steps are. I used a solicitor in the past but can't afford to do that now...
Can anyone help?

With this sort of thing a solicitor is really needed, they should be able to move things along quickly and spending that money now could save you in the long run.

I know a friend of mine who went through divorce had similar issues, and had to return to court to get things moving. Hopefully if a solicitor writes to her it may be warning enough.

I'd prefer to do it myself as I've spent tens of thousands already!!
I'm tempted to break the court order myself and delay paying spousal maintenance as with this she can afford to pay the mortgage..... However, I know this is not really an option

I would say witholding the payments isn't a good idea as it won't put you in a good light if you do end up back in court, my view is always play by the book as it will show your ex up as being difficult and not following the order.

Does anyone know what the process/form are to get back to court and timing etc?
Also what are the chances of costs being awarded if the judge concludes her inaction is delaying and jeopardising the sale??
