[Solved] Hospital appointment court cancelled

Review hearing next Tuesday but just been informed that ex has hospital appointment tomorrow and apparently she claims there may be some side effects so it's likely to be postponed. As barrister had been scheduled to attend there will be costs incurred by me. I wonder if I can ask and see evidence exactly when she knew she had a hospital appointment tomorrow and claim costs if it was not today ? !

CAFCASS have produce their report which is quite positive and included observation visits again quite positive. They more or less recommend what I have now which is for tea one night in the week and every other weekend. I actually want more as I have the time and resource and has been proven that I am capable however CAFCASS say mum and dad should sort this out themselves. They miss the point the mother will not communicate with me , two separate MIAM sessions but she did not like the mediator so mediation is never going to work so we need a defined court order. In addition she has shown no flexibility whatsoever over the last year and I have numerous examples of how awkward she has been !

I think you should write to the court and object to the postponement because its too short notice to reschedule your barrister and the issue of having to therefore pay the barristers costs. You can make the point that you would like to see some kind of proof of when your ex knew about the appointment etc....although costs are so rarely awarded in family courts, you could ask for this to be considered if the other party have not been expedient in giving notice of the appointment and are using it tactically to postpone the hearing and cause you further expense.
