How likely would it be for the court to grant me access to take my sons abroad for a week next year?
Had families first meeting today with ex before court on Wednesday and when I asked again about holidays she has once again said no not happening.
Now I have 2 other children and I don't want my boys to be left out. They missed last holiday as ex refused. How likely would it be to.be allowed to take them. Obviously we would book it and have a year to pay it off
How old are your boys? The court needs to see proof you have tried to reach an agreement yourselves through mediation. If that fails, court can then be involved.
My advice is to politely message your ex and see what she says. If she says no inform it will have to go to mediation.
Use www.nfm.org.uk to find a local mediation service. If she does not turn up ask the mediator to complete the relevant part of the C100 (you would need a Specific Issue order).
Think that is all for now. Depending on the age of your sons may be the key factor as to how quickly a court could rule.
They are 8 and 10. There is already a court case open as she stopped contact Jan until may. Second hearing on Wednesday.
Just wanting to book something for next year

As you have ongoing proceedings you could ask for it to be considered, as you've written a position statement you could include a short paragraph requesting this, pointing out that although it wouldn't be until next year you will need time to book and then pay it off over the coming months.
It's difficult to predict what a court might decide, I know there is a situation concerning one of your sonsand a supposed illness....have you had any more input from Families First on the direction this will take, or any more thoughts of what you will ask the court to do about it?

We had the meeting today with families first. It was pretty pointless and a waste of time. The women is completely biased and my ex just nodded a and said yes or no. Told the kids off for letting us take them to the cinema as they are going with grandad!
Didn't want to give too much away as to what I'm aiming at in court else my ex won't turn up.
No worries, mention permission to take them on holiday in your statement, state that you will inform the mother where you are going and give her any other relevant information and if the court agree to the holiday, make sure you get in the order that the childrens passports be supplied to you a month before you are due to leave. If the children don't have passports, offer to arrange and pay for them, I think this then gives you the right to keep hold of them.

I think as Mojo has said if you ensure that when in court you state that you will give exact dates, hotel details, flight times and numbers ect then I would think A judge would rule in your favour, It may also be worth adding in that you will get the boys to phone her midweek as this could also go in your favour too.

Agree with Mojo on the passports. The exception being that even if you pay for them the passports must be held by the parent with residency.
Once you have used them for their purpose they must be returned.
Include a line in your statement to the effect of: "I would request that the Court also includes a further stipulation/order that X and Y can travel for up to 14days abroad with me" and go on to say that this will prevent any further court hearings being likely as mum has previously refused a holiday in 2014.
