[Solved] Holiday issue

Hi gents. Back again.

Every thing been great with my son since I had my final order a year ago. Ex is still pain in the [censored] but relationship with my son is great so that what counts. Anyway I have this issue in front of me.

I'm taking my son away abroad on 28 days which has been agreed with ex I've asked for the passport for safe keeping but she is refusing to hand it over until a week before. I want it for safe keeping & to book check in etc. I do not trust her to give it to me as she already caused loads of problems applying for the passport. Am I within my right to apply to courts for a urgent hearing as I fill she could stop me from. Going on holiday & hand over the passport sooner?

Hi there

Great to hear things are great with your son.

You are within your rights to apply for an urgent Specific Issue Order to have the passport handed over. I would take in the application in person and explain that you are very time limited, the court office should fast track,you.

You could try writing a formal letter requesting that the passport be handed over immediately, as it's important that you are able to finalise the booking/check in.
State that unless you receive it by return, you will have no alternative but to make an urgent application to court.

Thanks alot mojo. I've followed what I feel is the right prodecudure. I've asked for it in person. Then a polite text & finally a recorded delivery letter. All asking to resolve the matter amicable. I said if not I'd have no altertnative but to look at legal action. Her reply " as you now have said that I will hold onto the passport until you do "

My hand is now falsed & I'm going to the court tomorrow with the paperwork. Wish me luck & let's hope me & my son get that holiday I fought so hard to get with my child arrangement order.

I hope that you have that reply in writing or text - if it goes to court, I can't see a judge being at all impressed with her attitude.

How did you get on at court? Did you get before a judge for an urgent hearing?

Hope it's going to plan for you, have you got a date for court yet? It should be a formality in my opinion, I would also try and get something in the existing order that addresses this issue for the future, such as handing his passport over a month before the holiday is due to start.
