Hi

My partners ex husband intends to reduce the amount of CSA payment that he provides to her due to him having the children for two weeks in the summer holiday, she still has bills to pay whether the children are there or not. Can he do this.

Regards

Jasoni

Hi

He can only do this by a variation, and he can reduce it by 1/7th of the assessed amount for each 52 days (overnight stays) he has them each year, so a two week holiday would not be enough to warrant the variation, so it won't succeed, unless that 2 weeks takes is in addition to existing overnight stays and then goes about a 52 day multiple. It might be worth trying to negotiate something for those two weeks, but that's entirely up to you.
