I'm not sure if anyone can help me, but I'm at the lowest point of my life with this and would really appreciate any advise on this topic.
I should start by stating the following:
a) My wife left the Family home almost two months ago and took both of my children with her.
b) No "reason" has been forthcoming and all communication (other than me texting my wife & daughter) has ceased.
c) I was not "beating my wife up"......or Kids for that matter.
d) I was not having an affair
e) We've been married for over 15 years and have lived in Ireland for all that time
f) My wife has successfully obtained a "protection order" against me and is seeking a "barring order"....The barring order hearing is in 4 months time.
g) I have no idea what my wife alleged to obtain the protection order, but I have hired a solicitor and requested he submit an application to discover exactly what she alleged.
h) I have "countered" with an access summons, which will be heard on the same date as the barring order hearing.
The issue I have is that I have ZERO contact with my kids and there appears to be absolutely nothing I can do to remedy this
My wife will not answer her phone and/or texts, neither will my daughter and my son does not have a phone.
Clearly this is not in the best interests of my children and If I'm honest, it's not in my interest because I'm really struggling to come to terms with this.
Does anybody know if there is any legal route I can take which will provide me with some time with my kids, without having to wait another 4 months to see them?
Understandable what you will be going through however keep strong and keep focused on the end goal which is contact.
I would suggest trying to mediate via established organisation you might want to look for mediation service were you live. Yes it will cost money however trying to mediate is the first step and if that fails or she does not turn up... The judge in the court will ask questions to her and will not be happy.
What ever happens between yourself and your ex has no barring to the CHILDREN ... who are the innocent party and im sorry to say alienation might occur as the mother might pollute their minds to think differently.
Apologies.....Should also have mentioned I have already discussed with the Mediation office, but to the best of my knowledge, my wife has refused mediation services (I will have that confirmed by them next week).
Ahh ok no worries
I take it you have filled in/sent off your c100 form to the courts for them? If not then I would recommend sending the forms to the court with the copy of attempted mediation signed to show you had tried mediation. You should be able to get a letter back within few weeks with a date of attending court.
It is a cruel World and without your ex willing to co operate it will be tough. Also it will be an idea to not bombard her with multiple messages and calls as she can contact the police and report you.
Just be amicable and reasonable and hopefully she will see sense. It looks like she is not looking to co operate but I hope it goes well.
