Hi guys it's been a while but once again I'm back for some more valuable help. My ex partner has decided to stop contact with no explanation at all. This is court ordered contact which was ordered after I went through court to get DNA testing and access. I didn't even find out from her. The contact centre emailed me saying she no longer wanted our son to attend.
In addition to this even when contact was taking place she would either not turn up on time or my son would apparently be to ill to attend and this happened 8 times that I was told he was to ill. I set contact up literally on her doorstep. The centre is on her road just 3 minutes walk from where they live. Furthermore she use to talk to me like rubbish in the contact book as if I was a child and didn't know how to look after my own son.
What do I do is she in breach of the contact order as this is an order set up and made by court and how do I get to see my son again ??
Peter
When are you next in court?
Hi there
How long have you been using a contact centre? I hope that the court ordered that a review hearing be held after a certain length of time and that they haven't just closed the case with no further progression in mind.
She is in breach, if the case is still ongoing, you can either write to the judge that made the order and ask for an urgent return to court because she has stopped contact, or you can apply for enforcement using form C2 which you would need to pay for.
If the case has been closed, depending how long ago the final order was made, you could try writing to the judge that made the order and ask if they would bring the case back to court, or you could just make an application for enforcement using form C79.
All the best
I don't think there is another hearing and the case is closed I'm sure at his hearing after the DNA test they ordered contact to be supervised and ordered that both parents were to agree progressive contact leading up to over nights ect, I know pete has been in the contact centre for ages well longer than normal and reading between the lines his ex had no intention of getting out the contact centre and has been stringing him along all the while because they was nothing set in stone by the courts so she has done what she has pleased throughout.
Pete as I have said all along write to the judge and explain the situation and if nothing comes of that apply to the courts again mate you've got a brilliant case and your ex needs a kick up the [censored]!!!
All the best
