[Solved] Hearing date - Enforcement Order - 03/11/2014

Just over a week ago I submitted forms C79 to apply for an Enforcement Order due to my daughters mother not allowing any further contact with my daughter despite a Contact Order in place stating that I would have my child 2 out of every 3 weekends on rotation from Saturday at 10 am until Sunday at 4 pm. My daughters mother has taken the decision not to allow this to go ahead any more.

It has since been 3 weeks since I have seen my daughter, now with a court date of the 3/011/2014 it appears I will not see my child for at least another 5 weeks!.

What I have received today from the courts papers for a Child Arrangements Programme (CAP 01), involving CAFCASS acting as an apparent mediator in the case. What is also enclosed is a booklet which I am to fill out called 'The Parenting Plan'.. asking questions such as 'What parenting decisions do we need to consult each other on?' and 'Should we discuss how we talk to the children about the other parent'..

Seriously, are they taking the p*ss??!.

I have submitted a request for an ENFORCEMENT ORDER because I HAVENT SEEN MY CHILD IN WEEKS!! although Ive spent thousands of pounds in getting a court order!!

By the time I get to court I will not have had my daughter for a good 7 weeks. How is this friggin booklet supposed to help!?.

I'm sure an enforcement order is supposed to be called within 3 weeks that sucks, are cafcass going to see your ex and try and mediate between now and then?

I called them today and they said they havent recieved anything yet, but they told me the process for enforcement orders have changed. They letter I got back for the hearing is under the title: Directions at Gatekeeping/Allocation - Child Arrangements Programme (CAP 001).

I dont understand what theyre expecting to accomplish, there cant be any mediation, its plain and simple that she will not abide to the court order.. Think I will actually go to the court tomorrow to find out what this is all about. I thought they would have seen me much earlier too..

Hi Dan,

Really sorry to hear about what's happening. You said the date was set in November.

Hope this has all been sorted out? Any progress?

Good luck.
