Hi everyone,
Ive submitted a form C79 for enforcement of a contact order, which is not being abided to. However, with the papers I have recieved back it mentions a C2 form if you want to apply for an order.. What is a C2? what is its purpose? and in comparison to the C79??..
Any help will be much appreciated..
Danny
Form C2 can be used for different reasons -
To ask for permission to apply for an order, if you don't have PR...for example grandparents or fathers that are not named on the birth certificate.
To add another application to existing proceedings.
To ask to be discharged from proceedings
To add another party to proceedings.
Ah, I see.. So if I have applied for an enforcement order and have filled out and submitted the C79, that is all that is required?
If you have an existing contact order that isn't be complied with and had a warning notice attached then you can apply for enforcement and as you have done, submit form C79.
Do you have a case ongoing, aside from the enforcement application you have made? If you do then that would be a reason to submit a C2, as you would be adding it as a further application to existing proceedings.
No, nothing ongoing..
My daughters Mother applied for a non-molestation order last month that was dismissed by the court, although there was an undertaking issued for 4 months whereas we will only be in contact in reference to visitation and any health emergencies.. Since then she has decided to not go ahead with contact (revenge I guess)..
I wouldnt imagine the undertaking would be relevant in this enforcement application?? or am I wrong??..

This might be useful to explain the process, there's a section on enforcement.
thank you kindly..
