When going back to court after 11 months of a long child arrangements proceeding including a fact finding and various allegations....do I need to reapply with a fresh c100 form or is there another form I need to apply with?

hi,

it depends what the problem is. is your ex breaking the rules of the court order? or is she playing around with stuff written in the recitals section?

if she is breaking rules of the order, then you apply for enforcement. you complete form C79 and pay the fee. think its same £215 as a c100.

if you think order is restrictive or want more time with your kids, or ex is messing around on smaller note, then you complete C100 form again, and in it, state that you are applying for a variation of the order. but for this you will need to apply for mediation, so they give you permission to go back to court. sit a MIAM assessment by yourself and let them decide.
