I went to my son's Gp surgery after hearing he had TB and again referred to social services. I gave a letter with birth certificate and asking for them to share son's medical records. They have just called me back saying they cannot give me son's medical records without a court order saying I have PR. I have told then this is incorrect, as I an named on birth certificate, which they disagree with. I had this conversation with go administrator,who said there was no practice manager...she said the lead doctor had made this decision and I needed a Court order. I am ringing after 4pm to speak to him. I said my son has TB and she said I cannot speak about another patients records!! Surely they cannot withhold his medical records? Any knowledgeable advice?

Rang my sons GP surgery after 4 pm, and was told that the administrator and doctor had all gone home...just unbelievable.
I spoke to a receptionist who again said that i need a court order... which i said was incorrect. She then started saying stop speaking to me or i am putting down the phone.. i thought it was my sons mum again...How bizarre! Then a senior receptionist came to the phone who was much more sensible and human. She said again said that i needed a court order as i could be anyone. I explained i came in with my sons birth certificate earlier which the receptionist did not want to photocopy, though i asked for it to be. She then said you could be anyone and we need to make sure he is safe! I said regardless of what you think i have a legal right as a father with PR to see my sons medical records. It is not up top the GP surgery to withhold this. I asked if they had a generic email address to make a complaint but they said they did not, only a secure email for NHS. I said that i would be complaining to NHS England and Local CCG. I was very polite but their conduct and false information they are sharing is a big concern. I am aware the GP is in a poor area of inner London, but jeez...my son is subject to social services referral, picked up TB from mum but they are more interested in denying me access.
You’re right. You may have to contact the area health authority, if you can’t get any joy with the surgery. Here’s some further information that you may find helpful

Like Mojo wrote, you are absolutely right that by law you don’t need a court order to access his records. The flip side is, this is not really enforceable, and remember that at some point in the near future a social worker is likely to be writing a section 7 report about your child and will be contacting that same GP surgery. Their feedback will influence that social worker’s recommendation.
Just thread carefully, I had the same thing happen to me, my son’s GP surgery demanded a court order before giving me a copy of his records. I didn’t really need that fight, so I just swallowed it and gave them the order.
You may want to consider putting your request to them in writing so that if need be, you can use it as evidence later. Avoid arguments in person or over the phone.
Also, keep in mind that GPs have a hard job. Each GP sees up to 30 people a day, and everyone is trying to get something. A little kindness and understanding can take you a long way when dealing with GP surgeries.
I agree absolutely with the above - if a polite verbal request doesn't work, then definitely keep it polite and put it in writing. That way there is nothing that can come back to bite you in court.
Thank you both. i had already typed out a complaint but i do want to make matters worse, so will not send it. I have the template letter asking for access to medical records from Mojos link, so may just send this to NHS England. I have not got an email address for GP surgery and going around them is probably a more sensible option, so not to create more drama and direct issues between us.
superprouddad has given you some excellent advice, a softly softly approach will work better for you when dealing with the various agencies.
