Hello does a grandparent seeking contact with his grandchild need to apply to the courts for permission to apply first? What form is it C100 or C2 ?

Hi there Jnny,
From my understanding, there are a few cases where you can apply directly to the court as a grandparent to get contact (which would be via form C100).
- you are already a legal or special guardian of the child
- you already have a residence order for the child
- child has lived with you for an extended period (3 in the last 5 years)
- you have the permission of EVERY person with parental responsibility for the child
If you do not fall into these categories, it would be form C2 and seeking leave of the court.
If it is possible to work out an arrangement with the parent(s) for regular contact outside of court, maybe trying this route too may help save on time, costs and emotional energy in the long run?
