Just got the order through and the next court hearing is a DRA. It does have on the order that contact is at the discretion of the social worker but the social worker is saying it is still up to the mother and she will have to ask her and see what she says . What can we expect from the DRA are we able to put a position statement forward as we were not allowed for the first hearing .
hi,
thats very strange you were not allowed to have a position statement. did they give a reason for that? i have had 4 court hearings to date and i have turned up on the day with a position statement and it was fine.
DRA hearing is annoying. this is where judges do not like to make orders. they expect both parents to come to agreement. in mine, ex was getting legal aid. S7 report was fully in my favour. there was no cafcass officer present. ex basically disagreed with every thing in the report and just wasted time.judge ordered that cafcass report writer needs to be present at next hearing. it went to a 3rd and final hearing
Her solicitor opposed it saying we needed to ask for permission via a court application and no statements would be read out . I was going to hand it in an hour and a half early and had a copy for the other party . I'll try again with a new one after I have seen the section 7 report .
