[Solved] Final Hearing this afternoon....advice please!!!

Good morning.

I am due in court at 2pm today 3/2/16 for a final decisive hearing. Little bit of background, I have been vying for contact with my son for the past 3 years, I am trying to extend my time with him, she is trying to decrease my time with him and has taken me to court to this end,.

The first hearing went well, I am representing my self, and in the first hearing I made my intentions to seek 50/50 shared residence of my son clear, the case was adjourned so that I could file a statement to the court outlining my proposal, then my ex filed her response to me.

Now my question is this, I have prepared a response to her statement as she has, fabricated a few things and I have gained evidence to prove this. Do I have to file this with the magistrates before the hearing? or do I take it in with me and bring it up in court?

Also, what is the process? what will happen when I go in, will I be given a chance to talk and present my case, or will the magistrate purely look at the statements that have already been filed and make a decision based on these??

Any help or advice you can give me would be very much appreciated!!

I'm sorry I missed this...although you left it a bit late to ask advice Scott....how did it go?

Strictly speaking, any evidence relied on in court needs to be filed with the court beforehand, hopefully the judge has been a little flexible with you as you are self repping. If you haven't been able to use your written response then you would have been able to make a verbal submission.

I did leave it a bit late, thought I had it all in hand, just some last minute nerves got the better of me!

It went well, I submitted my evidence to the magistrates before we went in and also gave a copy the her barrister, he tried to block the evidence due to it damaging his case but it went to the judges anyway and I exposed her lies.

Anyway, after a 3 1/2 hour hearing I walked out of there with double the time I had before, not exactly what I asked for, but a good result in my opinion!

She was fuming with the order, probably cause she realised she spent a fortune for nothing! (she was the applicant!)

Very happy with the result

That is excellent. How great to hear. But may I ask, why did you wait 3 years, out of interest?
