Hi there,
final hearing beginning April.
At the FHDRA hearing last time, The court ordered(handwritten on paper) ....
Statement from Father-to send 4 copies to court + court to serve on local authority by 22nd feb
Statement from mother exactly as above for father, a week later.
However now we have received a typed letter from the court stating :
Both parties to send narrative signed detailed narrative statements from themselves and any other witnesses.
Copies of all statements be sent to courts and soc worker
Then soc worker needs complete addendum sec 7 report..
My question is, does he just sent 4 copies to the court for them to pass on, or does he need post to soc worker + mother as well himself?!!
Hi smallnanny
That's a little conflicting isn't it! It might be a good idea to call the court first thing on Monday to get clarification.
The handwritten order that states 4 copies to be sent to the court would indicate that they would be sending a copy to the other party, the social worker etc, but the typed version seems to indicate that you need to send copies to all interested parties yourselves.
The court office will explain what you need to do.
I have been trying to contact the court all day, it says lines busy please call later. grrr!! also the dates differ on both for deadline!!
The courts also did a hand written letter when was adjourned last time. Postcode was wrong for last hearing(luckily I checked)
Well apparently both parties meant to send to each other.
We sent yesterday to the ex(1 day late)It was stated in letter if not received by the date specified, cannot give oral evidence in court!!! Hope this isn't the case...
Other issue is ex has moved house in the last week(was meant to be 2 days after last hearing) and was meant to give new address to all parties including courts.
We never got that till yesterday!!
How do we prepare for final hearing? Statements sent etc. Anything else we need to do please
Did you receive her copy on time?
I would write to the court to tell them that the other party did not give you their change of address as directed by the court and you only received this yesterday which meant you were unable to send the statement until then. Ideally you should have contacted the court prior to the date specified for re diving statements to inform them that you didn't have an address. Hopefully it will be ok.
There's a video of the final hearing and if you use the search tab at the top of the page there should be plenty of info there.
You will need to prepare a closing statement, which is a a short paragraph summing up what you would like the court to do and why. You may be required to cross examine CAFCASS if they are to be present and also the other party, so it's prudent to prepare some relevant questions for them.
I still sent 4 copies to the court. The other party was meant give new address 2 days after last hearing.
The statements they asked for was to include what they both want courts to do
+ a summary of their proposals for the arrangements for the child.
Her copy is meant to be by 7th march. so not received yet.
thank you for your help
