Hi. Today I got court order from a hearing I had months ago. With it was a C120 witness statement form. Given that position statements have been submitted to the court and exchanged, what is this form for? Do I need to complete it?

Hi there

Does it mention in the order that they want further statements?

You could call the court and ask, or if there’s no specific instructions concerning the C120 in the order you received, you could complete it and take it with you to the next hearing.

Hi. No. All it says in the order is positoon statements to be submitted and exchanged by x date, which is done, and that I have to send her the court bundle 7 days in advance, which is impossible given I only got the order today and hearing is in less than 7 days.

... Perhaps they enclosed the C120 form for you to use for the statement, parties can use that, or produce their own typed version, both are fine.

Has there been a delay in receiving the order?

I think it’s ok to provide just the index of the court bundle to the other party, I’m pretty sure that’s all that solicitors provide when they’re tasked with preparing the bundle., maybe check that with the court.

All the best

I have done the position statement the judge asked for and submitted it in May.

There was a delay in the order. Some 3 months

If there’s any issue about you serving the bundle a little late, make sure the court understand that the huge delay in receiving the order meant that it was impossible to fulfil the conditions.

All the best for court.
