Hello All
So the FHDRA is in a few weeks and here are the basics:
I am taking her to court to get 50/50 share of our two boys.
CAFCASS checks done "No harm boxes are ticked on the C100" and "There is no further role for Cafcass following the FHDRA"
The CAFCASS report did make some recommendations, ("advise to the court") mostly suggesting mediation (which the ex declined when I suggested it)
The report states:
"If parties are unable to agree a way forward, then statements will be required and the matter set down for a contested hearing".
We have had no request from the court for position statements - so do we just show up in court with nothing prepared?
What does the court go on in the FHDRA ? The CAFCASS report?
If so then I presume we are just going to adjourn for the mediation to happen which could have been already done?
Finally - what would be my chances of getting an iterim order so that I can see them 50/50.

Hi,
From experience, as Cafcass have not given advice to court that is supportive of 50/50, then it will be very difficult and judges will make final decision if both parents can not agree. It's possible that at first hearing, that they will order both of you to try mediation, or they might decide against it if they think it will be waste of time.
What are your current arrangements and how old are kids if you don't mind mentioning. Also do you live close by to them?
