[Solved] FHDRA/Directions Appt

Hi

Just after some clarification

I have received the court papers today following my application for a child arrangements order.

The first document is an Order stating the FHDRA will be on 18 December at 10am. Need to arrive an hour before for pre-hearing discussion. The form is a C21

The second document is a Notice of Proceedings Directions Appointment referring to “about the Directions Appointment” on 18 December at 10am. The form is a C6

So is the FHDRA also a Directions Appt. I thought Directions Hearings and the FHDRA were two different things.

Also the order says that no document other than that specified in the order or sent in accordance with the Rules or Any Practice Direction shall be sent without the courts permission.

The notice of proceedings refers to a bundle 5 days before hearing if being represented by a solicitor, which I’m not as I’m self representing

I’m assuming the FHDRA and Directions Appt are the same and will follow a format of discuss to reach agreement if possible and that I don’t need to submit any papers in advance, the pre hearing meeting will be a form of mediation and the Hearing at 10am will either confirm an agreement or define what is needed next

hi,

is there anything written in the form c6 and c21? anything a judge has already ordered?

if there blank, then I am ssuming all you do is turn up to court with the paperwork.

take a position statement with you. its a very standard practice to take one to each hearing. take 3-4 copies, so you, cafcass, court and your ex gets one.

Nothing that I can see, just refers to bundles being required 5 days before if a solicitor is being used

I have written a position statement, does this need to be sent to the court in advance or can I use it as a discussion document at the FHDRA? It basically details a plan around what I’m looking for in terms of half the school holidays on top of my 3 days a week

in 2019 I was denied a fair share of school holiday time and had two upset children as a result of lack of time with me.

hi,

if your court papers do not state that you have to submit position statement in advance by certain date, then all you do is bring it with you on the day. i hired barrister for my hearings, and we just turned up with position statement on the day.

I’m happy to do the FHDRA without representation as what I’m asking for is basically what I have anyway just wanting to remove the control my ex has over school hols leaving me begging for time with the kids. In theory it shouldn’t be that hard to sort out

If we can’t resolve at the FHDRAa might use a barrister for the next stage

When I had my fdrha the usher refused to let me submit it on the day as she said I wasn’t allowed to file , so just to make sure I’d email it to the court in advance and take copies on the day none the less
