I have a Fedra hearing in two weeks an have to prepare statements, have a few questions.
What is a fedra hearing?
And what takes place with the statements
Thanks.
Howdy Scouse0,
I think you're referring to FHDRA? Which is a First Hearing & Dispute Resolution Appointment.
From my (limited) experience, its an opportunity for the court to get an idea for your position and that of the other side - and to see if any headway can be made without further hearings.
Keep your spirits up after this first hearing as you may not make as much progress as you might anticipate! I remember going to the hearing and having contact stopped until CAFCASS did an initial interview with me + my child's mother - which took almost a month. I had to push to find an empty gap in the CAFCASS officer's schedule and ended up going in on my birthday to expedite things as much as possible.
Some friendly reading on it here -> http://www.familycourtinfo.org.uk/i-need/what-will-happen-at-the-hearing/
Hope this helps,
Concerned Daddy.
Hi the FHDRA is quite straight forward and as CD says, it's main purpose is to see what both parties position is and whether any agreement can be reached.
Don't worry too much about your position statement, it really needs to be very brief - no longer than 2 pages of A4 and just needs to give the court a bit of background, what contact if any has been taking place, why you have made the application and what you would like the court to do.
Unless the court have asked for your statement by a specific date, you can just take copies with you on the morning of the hearing. You need 1 for the judge, one for the other side, one for you and one for CAFCASS.
Please ask if you would like any further information.
Best wishes
Jo
It's for an enforcement application. Had settlement hearing Monday where Contact was reinstated after two months of not seeing my son. But I have made an application for change of residence as my ex is never going to comply with a court order an this is the second enforcement proceedings I have had to do.
My son is only 2 an abit an he has been put through the court near his whole life, that is why I have made the application for a change of residence so I can guarantee a positive relationship between both parents
