Hi guys

Just recently had my consent order through confirmaing all financial matters between myself and the ex, everything covered.

Part of the order was about a joint loan that goes on for another 4 years which she is to pay me her half, £100, each month as i am the one paying the loan provider as they would only accept one payee.

Yep you guessed it, she is not willing to paying me her half although it is clearly stated in the consent order.

Yes i am planning on going back to the courts and no i can't afford to pay my solicitors anymore so have to do this myself with some help from some good people!!!!!

I have looked at the D11 form, would this be the best way, the courts are not much help as yet, they said speak to a solicitor or CAB, i emailed CAB about it and they said take her back to court!!!! Well thanks there as i had already explained it all to them in my email.

So here i am again, looking for some helpful information from some guys i know wil be able to offer some sounnd advice.

Cheers fellas

Hi

When you say it's a joint loan, is it in joint names, but you are the one paying it back, or is it solely in your name?

Either way (and I'm not knowledgeable on this, so I'd suggest that you ask the CAB some more targetted questions based on this), I would say that the court have effectively said that she is legally liable for half the debt, so it might be worth contacting the loan provider to tell them that as your ex isn't paying you, you want the loan split into two and you will pay your loan and they can chase her for her half.

One other question, are there children involved, ie are you paying maintenance for them?
