Obtained a court order which worked fine for over a year. Now mother continues to breach the order, taking my child out of school or not sending them at all to prevent me from picking up.
Is it possible to claim the costs of the application as a financial loss? I don't understand why I should have to pay for the other party not adhering to a legal court ruling?
Hi,
Do you know if your ex works? If not then don't think it be possible to claim costs.
If she works, you could apply for enforcement order and ask for a costs order to claim compensation. Would be up to judge to decide.
Does she have a solicitor? Could write to them and get them to remind their client to follow the order and stop breaching it.
