Enforcement Order

good evening,

I had better start by saying I not a dad I am a mum, it’s just I can’t find any similar advice groups etc for my situation for mums…

 

I left an abusive relationship in 2021… I have two children with the man I left. I dropped out of pressing any charges, I new I would have to try and co parent with him and felt maybe if I just let it go things would be easier. 
I was wrong! 

he withheld the children from me twice and we ended up in court and we got a child arrangements order, I didn’t have a solicitor and he did so things went in his favour but I was okay with that as long as we had a order in place and he couldn’t take them away from me again. 

he is currently breaking the child arrangements order and I havnt seen my children in 3 weeks. 
he has made more false allegations to the social services they are currently doing an assessment. 

I have applied for legal aid though a solicitor which I’m entitled to because of the history of domestic violence but because I’m self employed I can not get it urgently.

 

I am considering apply to the court for an enforcement order on my own, I’m just wondering if anyone has had to do this and if you could give me any advice on it. 

my children are only 3 and 5 I miss them so much it honesty hurts.

I can understand how painful that must be.  You should be able to get support from a domestic abuse agency near where you live.  You can google to find one.  Does the child arrangements order in place have a  'live with' specifying where the children live?  If so, you can report him to the police and the children should be returned.  The Rights of Women website has lots of information - rightsofwomen.org.uk - and they have a helpline.  Also the advicenow.org.uk website will help you make an enforcement order application without legal representation.
